Personal Injury
As a certified mediator and a litigator with nearly 30 years of legal experience, Wayne Argo, P.A. provides clients throughout Florida with exceptional representation in personal injury and wrongful death matters.Â
To obtain recovery for an injury or wrongful death, an injured plaintiff must prove that the defendant was at fault for his or her injuries. Under Florida law, an injured party has four years from the date of the injury or reasonable discovery of the injury and two years from the date of the wrongful death to bring a lawsuit to recover for damages. Known as the statute of limitations, these time limits make it critical that you consult an experienced attorney as soon as possible following an accident so as to avoid being barred from bringing suit.Â
Mr. Argo has represented clients who have suffered harm due to:
- Car / Automobile Accidents
- Truck Accidents
- Motorcycle Accidents
- Wrongful Death
- Premises Liability
- Construction Accidents
- Boating Accidents
- Dog Bites
Motor Vehicle Accidents and Injuries
Motor vehicle accidents can have devastating results, causing serious injury and even death. Accidents involving motorcycles and trucks can be particularly disastrous; motorcycles because of their unprotected nature and trucks because of their unwieldy size and weight. If you have been in an automobile, truck, or motorcycle accident, it is important to seek immediate medical help and to record as much information as you can about the accident scene, parties involved, and witnesses. Consult an attorney as soon as possible to ensure that your suit is filed within the statutory limits and that all relevant evidence is preserved.
Boating Accidents
Boating accidents involve a vessel, which is in, on, entering or exiting the water, capsizing, colliding with another boat or object, sinking, or causing the injury, death, or disappearance from onboard of any person. If you have been injured in a boating accident caused by the negligence or recklessness of the boat operator or another party, you may be entitled to recover for the damages you have suffered, both economic and non-economic.
Dog Bites
If you have been bitten by a dog while in a public place or lawfully on private property, the dog's owner may be liable for any damages caused by the bite, whether or not the animal was known to be vicious. However, there are defenses to dog bite liability, such as where the injured party was negligent or ignored a warning of the dog's aggressiveness, so it is critical to retain an attorney who is knowledgeable about the nuances of this particular area of law. Â
Premises Liability
An injured plaintiff or the family of a deceased party may be able to recover damages from a landowner if they suffer an injury or wrongful death due a defect or dangerous condition on any improved real property. This includes defects or unsafe conditions in construction or negligence by the caretaker; for example, a property owner may be found negligent because he or she failed to clean up spills, warn of a potential danger, or light a dark parking lot to prevent against accidents or even assaults.
Wrongful Death
A claim of wrongful death arises when a loved one dies due to the actions, negligence, default, or breach of contract or warranty of another party. Under Floridaâ??s Wrongful Death Act (sections 768.16-768.26) surviving family members of the deceased can bring a wrongful death suit any time the deceased would have been able to bring a personal injury claim had he or she survived. If you have recently lost a loved one due to the negligence or wrongful acts of another party, Wayne Argo, P.A. can help. Mr. Argo may be able to help you recover for:
- Lost support and services
- Loss of companionship and for mental pain and suffering
- Medical or funeral expenses
